ARBDD announces new fines starting November 4, 2022

The Administration of the Danube Delta Biosphere Reserve informs you of the changes made by Government Decision no. 1194 of 2022 on the limits of fines provided for in article 13 for the contraventions listed in article 12 of Law no. 82/1993 regarding the establishment of the Danube Delta Biosphere Reserve, with subsequent amendments and additions:

Fine from 1,000 lei to 5,000 lei for individuals and from 10,000 lei to 15,000 lei for legal entities:

Article 12 point:

5) access and movement by naval or road means on the territory of the reservation without the regulatory acts issued by the Administration of the Reservation or in violation of their provisions, with the exception of light boats belonging to the local population and its first degree relatives and used for personal purposes.

6) non-compliance with navigation and traffic rules on the territory of the reserve

7) flying over the territory of the reservation without the regulatory acts issued by the Administration of the Reservation or in violation of their provisions

18) cutting or damaging trees declared monuments of nature or in strictly protected areas

19) harvesting of species of plants and animals protected or declared monuments of nature

36) the use of motorized boats that are not equipped with monitoring systems

Fine from 3,000 lei to 6,000 lei for individuals and from 25,000 lei to 50,000 lei for legal entities:

Article 12, point:

8) disembarking passengers or tourists at the natural shore, except in cases of force majeure, which will be notified to the Reservation Administration

9) camping outside the approved areas or under conditions other than those authorized, as well as non-compliance with the rules established for the use of camping areas

10) photographing or filming for commercial purposes, without the regulatory acts issued by the Administration of the Reservation or in violation of their provisions

25) sport/recreational fishing without the regulatory acts issued by the Reserve Administration or in violation of their provisions

26) sport/recreational fishing in prohibited areas or during periods of prohibition

27) family fishing without the regulatory acts issued by the Reserve Administration or in violation of their provisions

40) practicing water sports on the canals and lakes in the perimeter of the reserve

Fine from 5,000 lei to 10,000 lei for individuals and from 25,000 lei to 50,000 lei for legal entities

Article 12, point:

3) the entry of people and the penetration of naval or road transport means into nesting places, the destruction of nests or nesting places, as well as the harvesting or destruction of wild bird eggs

4) the entry of persons and the entry of unauthorized naval or road means of transport into strictly protected areas

41) failure to ensure the sanitation of sport fishing sites or camping sites

42) the access of natural and legal persons to the territory of the reservation without regulatory acts issued by the Administration of the Reservation or non-compliance with their provisions

1) the execution of landscaping and construction works, of whatever nature they may be, without the regulatory documents issued by the Administration of the Reservation or in violation of the conditions stipulated therein

2) damage to natural or landscaped banks, land and vegetation by moving machinery or by carrying out operations

29) organizing and carrying out economic, tourism and leisure activities in areas belonging to the natural heritage of the reserve, without the regulatory documents issued by the Administration of the Reserve or in violation of their provisions

30) discharge of waste water or petroleum substances on land or in surface or underground waters located on the territory of the reservation

31) throwing into waters, scattering on land or storing waste in unauthorized places

32) abandonment of machinery or assemblies in unauthorized places, regardless of the land owner

33) pollution of waters and lands on the territory of the reserve through the discharge of waste water or the scattering of waste resulting from economic activities

34) the use on the territory of the reservation, in agriculture, forestry and fish farming activities, of some chemical products and equipment for their administration, without the regulatory acts issued by the Administration of the Reservation or in violation of their provisions

38) the movement of ships, motor boats, as well as motor vehicles in strictly protected areas

11) the production, by any means, of intense noises in the perimeters of the nesting or shelter areas of birds or other wild animals, properly signaled

12) organizing fireworks without the regulatory acts issued by the Administration of the Reserve or in violation of their provisions

13) grazing on lands that constitute the public domain without the regulatory acts issued by the Administration of the Reserve or in violation of them. Regulatory acts can be granted for a period of one year or for several years

15) harvesting or burning reeds, rushes, hay, grassy vegetation and other plant remains from the areas belonging to the natural heritage of the reserve, without the regulatory documents issued by the Administration of the Reserve or in violation of their conditions, with the exception of harvesting reeds, rushes and of hay for the needs of the local population

16) the exploitation of woody vegetation in the areas belonging to the natural heritage of the reserve without the regulatory documents issued by the Administration of the Reserve or in violation of their provisions

17) harvesting for the purpose of commercialization, forest fruits, mushrooms, medicinal plants and some aquatic organisms, other than fish, from the areas that belong to the natural heritage of the reserve, without the regulatory documents issued by the Administration of the Reserve or in violation of their provisions

35) the refusal of persons to identify themselves, at the express request of the staff of the Reservation Administration, and to present the requested documents

14) grazing in strictly protected areas and ecological reconstruction areas

20) accompanying herds and herds, on the territory of the reserve, by dogs that are unjudged, unvaccinated, unwormed and in numbers greater than one for each herd or herd

21) abandoning, letting loose, not supervising pets on the territory of the reserve

37) introduction of non-native plant and animal species without authorization

22) commercial fishing in the areas that constitute the natural heritage of the reserve, without the regulatory acts issued by the Administration of the Reserve or in violation of their provisions

23) commercial fishing with trawlers inside the coastal maritime zone, delimited by the 20 m isobath

43) fishing with gear prohibited according to the legislation in force

44) possession, use and sale of monofilament nets in the perimeter of the “Danube Delta” Biosphere Reserve

24) commercial fishing during periods of prohibition

28) failure to immediately notify the competent authorities of accidental pollution, fires and other events that affect the environment, by those who caused them, as well as failure to take possible measures to limit their consequences

Fine from 10,000 lei to 15,000 lei for individuals and from 20,000 lei to 30,000 lei for legal entities

Article 12, point:

21) changing the use of land from agricultural or fishery developments, except for those provided for in Ia Art. 10 para. 4″1

22) non-compliance by the owners, lessees or concessionaires of the lands occupied by agricultural or fishery facilities, the use of which has been changed, without being based on specialized technical studies, from which the necessity of changing the use of the agricultural or fishery facilities can be derived

The counter value of the fines applicable on the territory of the RBDD constitutes income to the state budget for legal entities and to the local budget for natural persons.
